Service Terms & Conditions

1. Definitions and interpretations

These Terms and Conditions (“Terms”) set out the basis on which Prominent Plumbing, a sole trader trading in England (“we”, “us”, “our”), provides plumbing, bathroom installation, appliance installation and related services (“Services”) and supplies materials or products (“Goods”) to you (“you”, “your”).

A Customer is any individual, organisation or business that contracts with us for the provision of Services.

Services may be:

  • Emergency Services – urgent Services requested to be carried out immediately or as soon as reasonably practicable; or

  • Scheduled Services – non-urgent Services carried out at an agreed date and time.

 

2. The Order Process

2.1 You may request Services by telephone or email using the contact details in clause 12.

2.2 These Terms, together with any verbal estimate or written estimate, form the contract between you and us (“Contract”).

2.3 For Emergency Services, the Contract becomes binding once you accept our stated charging rates and agree for us to attend the premises.

2.4 If Emergency Services cannot be fully completed immediately, a Verbal Estimate will be provided on site. The Contract becomes binding once you accept the estimate and make any required payment.

2.5 For Scheduled Services, we will carry out an inspection if required and provide a Written Estimate by email. The Contract becomes binding once you accept the estimate and pay the required deposit.

2.6 All estimates are valid for 30 days unless withdrawn earlier.

 

3. Cancelling Your Order

3.1 Clauses 3.1–3.9 apply only if you are a Consumer.

3.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel within 14 days of the Contract becoming binding, except for Emergency Services.

3.3 The cancellation period expires 14 days after the Contract is formed.

3.4 If you request Services to begin during the cancellation period, you acknowledge that you may be liable for Services already provided.

3.5 Cancellation must be notified in writing (email is sufficient).

3.6 Refunds (where applicable) will be made within 14 days.

3.7 You remain responsible for:

  • Services already carried out

  • Goods ordered or supplied

  • Non-refundable supplier costs

  • Reasonable time and travel costs incurred

3.8 If clauses 3.1–3.9 do not apply, cancellation or rescheduling must be made by 5:30pm the working day before the appointment or charges may apply.

 

4. Charges and Payment

4.1 Charges are calculated as follows:

4.1.1 Emergency Services
Charged by time spent (minimum one hour), thereafter in 30-minute increments, plus Goods supplied.

4.1.2 Verbal Estimates
Charges will not exceed the estimate by more than 10%, except for obvious errors.

4.1.3 Written Estimates
Charges will not exceed the estimate by more than 20%, except where material costs increase.

4.2 Additional work or Goods require your consent.

4.3 VAT
We are not VAT registered. VAT is not currently charged. If we become VAT registered, VAT will be added at the prevailing rate.

4.4 Payment terms:

  • Emergency Services: payment may be required in advance or on completion

  • Verbal or Written Estimates: 50% deposit, balance on completion

  • Jobs over £10,000 may be invoiced in staged payments

4.5 Accepted payment methods: bank transfer, card or cash.

4.6 Late payments may incur interest at 5% above Lloyds Bank base rate.

 

5. Your Obligations

You must:

  • Provide safe access and working conditions

  • Ensure utilities are available

  • Obtain all necessary permissions and consents

  • Inform us of hazards, listed building status, or hidden services

  • Provide parking where possible

Failure to comply may result in additional charges or termination.

 

6. Our Obligations and Guarantees

6.1 Services will be carried out with reasonable care and skill.

6.2 A 12-month workmanship guarantee applies, excluding:

  • Blockages

  • Third-party work

  • Customer-supplied materials

  • Lack of maintenance

  • Installations over 10 years old

  • Work completed against our advice

  • Non-payment

6.3 Manufacturer warranties apply to Goods where relevant.

 

7. Termination

We may terminate the Contract if:

  • You materially breach it and fail to remedy

  • Access or cooperation is not provided

Outstanding Charges remain payable.

 

8. Personal Data

Your personal data is handled in accordance with the Data Protection Act 2018 and UK GDPR.

 

9. Liability

9.1 Nothing limits liability for death, personal injury, fraud, or unlawful exclusions.

9.2 For Consumers, liability is limited to foreseeable loss.

9.3 For Businesses, liability is limited to the lower of £500 or total Charges.

 

10. General

  • Each clause operates independently

  • No waiver unless in writing

  • These Terms prevail over any others

  • Complaints should be made using clause 12

 

11. Governing Law

These Terms are governed by English law.
Jurisdiction lies with the English courts.
